1. Scope of Application

These Terms & Conditions apply to all orders placed through this online shop. The seller is Ömer Mutlu, located in Germany. The shop is operated for private customers worldwide, except in countries where delivery is not possible.

3. Products and Order Process

All products displayed in the shop are non-binding offers. By placing an order, you make a binding offer to purchase. The contract is concluded when we confirm the order via email. We reserve the right to refuse orders in exceptional cases.


4. Prices and Payment

All prices are in Euro (€) and exclude shipping costs, which are displayed separately during checkout.

Note: According to § 19 of the German Value Added Tax Act (UStG), as a small business ("Kleinunternehmer"), we do not charge VAT and therefore do not display it separately.

Payment is possible via the methods offered during checkout. Payments are securely processed by third-party payment providers such as Stripe. For details on data handling by Stripe, please refer to their Privacy Policy ( https://stripe.com/en-de/privacy) and Terms of Service ( https://stripe.com/de/legal/ssa). We do not store your payment information.

The goods remain our property until full payment is received.


5. Shipping and Delivery

We deliver worldwide, except for countries excluded during checkout.


Delivery Times:

Germany: 5-10 business days

European Union: 7-14 business days

Rest of World: 10-21 business days


These are estimated delivery times. Actual delivery may vary due to postal services, customs processing, or other factors beyond our control.

Shipping costs are calculated based on destination and weight, and are shown before completing the order. Import duties, taxes, and customs fees may apply for deliveries outside the EU and are the responsibility of the customer. We are not responsible for delays caused by customs, postal services, or force majeure events.

Risk of loss passes to the customer upon delivery to the shipping address.


6. Right of Withdrawal (EU Consumers)

If you are an EU consumer, you have the right to withdraw from this contract within 14 days from the day you or a third party designated by you (other than the carrier) receives the goods without giving any reason.

How to Exercise Your Right of Withdrawal:

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by sending an unequivocal statement to:

You may use a withdrawal form template (available upon request), but it is not mandatory.


Effects of Withdrawal:

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.


Return of Goods:

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.


Exclusions from Right of Withdrawal:

The right of withdrawal does not apply to:

- Goods that have been customized or personalized at your request

- Goods that deteriorate rapidly or have a short expiry date

- Sealed goods which are not suitable for return due to health protection or hygiene reasons if unsealed after delivery


7. Returns and Complaints

Please inspect your order immediately upon delivery. If the item is defective, damaged, or incorrect, contact us within 7 days of delivery with photos of the issue. We will offer a replacement, repair, or refund according to your statutory rights.

For items that develop defects after delivery, you have a legal guarantee period of 2 years from delivery. During the first 12 months, defects are presumed to have existed at the time of delivery unless we prove otherwise.

In case of defects or wrong delivery, we cover reasonable return shipping costs.


8. Liability

We are liable without limitation for damages caused by:

- Intent or gross negligence

- Injury to life, body, or health

- Claims under product liability law

- Breach of a guarantee given by us


For damages caused by slight negligence, we are only liable if the breach concerns essential contractual obligations (cardinal duties), i.e., obligations whose fulfillment makes proper execution of the contract possible and on whose compliance you regularly rely. In such cases, liability is limited to damages typically foreseeable at the time of contract conclusion. This limitation does not apply to damages to life, body, or health.

Our liability for slight negligence regarding non-essential contractual obligations is excluded.


9. Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, or government actions.

If such circumstances persist for an extended period, we reserve the right to withdraw from the contract.


10. Dispute Resolution

We are not obliged to participate in dispute resolution procedures before consumer arbitration boards, but we prefer to resolve any disputes amicably and encourage customers to contact us first.


11. Applicable Law and Jurisdiction

These Terms & Conditions and all legal relations between you and us are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer residing in the EU, mandatory consumer protection laws of your country of residence remain unaffected and may provide additional protection.

For disputes with consumers, the courts at our place of business have jurisdiction only if the consumer agrees or if the consumer has no general place of jurisdiction in Germany or has moved their residence or usual place of residence outside Germany after conclusion of the contract, or their place of residence or usual place of residence is unknown at the time of filing the lawsuit.


12. Final Provisions

Should individual provisions of these Terms & Conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.

These Terms & Conditions apply in their current version at the time of your order.

These Terms & Conditions are provided in German and English. In case of discrepancies, the German version prevails.

About

After nearly 15 years in the creative industry, Ömer now dedicates his focus towards an artistic career in constant evolution. He continuously reinvents himself through exploration, refusing to be confined by a single medium, title, or predefined identity.

As an Austrian with Turkish roots, it has always been a matter of great importance for Ömer to empower people of color, namely motivating the younger generations to engage with art and culture and find their voice through creativity. This pursuit led him to found and co-publish two digital media magazines, which celebrate the various contemporary arts and cultures from Berlin to Baghdad.

Ömer's ideas are expressed beyond the camera lens or any tool of choice. The inspiration for his works thrive within urban landscapes as he captures lived experiences. These fleeting moments are raw, unpolished – often brutalist in aesthetic to provoke a message – yet remain deeply intimate.

Ömer approaches his craft with humility and reverence, believing that art, beyond its messages and critiques, can also simply be fun. It is the artistic process, not the result, that matters after all — and he is determined to keep moving.
